JURY AWARDS ELDERLY MAN $1,011,949.75 FOR DOCTOR’S FAILURE TO OBTAIN INFORMED CONSENT PRIOR TO COLON

On May 17, 2017, after some seven hours of deliberation following a week-long trial before the Hon. Judge Robert E. Senechalle, a Cook County jury returned a $1,011,949.75 verdict against defendants, Manuel Alva, MD and Medicor Partners, SC, and in favor of plaintiff, Ezequiel Flores, for the defendants’ failure to obtain informed consent prior to performing a colonoscopy on Mr. Flores. The procedure resulted in the perforation of Mr. Flores’s colon and subsequent severe personal injury.

Attorneys Steven Shonder and Peter Stamatis represented Mr. Flores and tried the case before Judge Senechalle in the Circuit Court of Cook County.

“We argued to the jury that defendants were negligent by not disclosing the risks and reasonably available alternatives to the colonoscopy because a reasonable person in Mr. Flores’s position would not have had the colonoscopy if told those risks and alternatives,” said plaintiff’s attorney Steven Shonder. “Mr. Flores has to live with the consequences of defendants’ error. “We are grateful that the jury determined we had proven our case and awarded Mr. Flores damages for his injuries. It was a privilege to represent him.”
